The Simple Version
We provide emergency call routing services. You pay us monthly. We both act professionally and treat each other fairly. These terms protect both of us.
1. Acceptance of Terms
By using CouchAlert ("the Service"), you agree to these Terms of Service ("Terms"). If you don't agree to these terms, please don't use our service.
These Terms apply to all users of CouchAlert, including business owners, employees, and anyone who receives emergency alerts through our system.
2. Description of Service
What CouchAlert Does
CouchAlert provides emergency call routing and escalation services for service businesses. When customers call your CouchAlert number:
- We route the call to your designated team members
- We send SMS and voice alerts according to your preferences
- We escalate through your team until someone acknowledges the call
- We provide call logs and reporting through our web dashboard
What CouchAlert Doesn't Do
CouchAlert is a communication tool. We do not:
- Provide actual emergency services (plumbing, electrical, etc.)
- Give technical advice to your customers
- Handle billing or scheduling for your business
- Replace emergency services like 911
3. Account Registration and Security
Account Requirements
- You must provide accurate information when creating your account
- You must be at least 18 years old to use CouchAlert
- You must operate a legitimate business
- One account per business - no sharing accounts between companies
Account Security
- You're responsible for keeping your login information secure
- You must notify us immediately of any unauthorized access
- You're responsible for all activity that occurs under your account
- Use strong passwords and don't share your login credentials
4. Billing and Payment
Monthly Billing
- CouchAlert costs $79/month, billed monthly in advance
- Your first month is free as a trial period
- Billing starts on the 31st day after signup
- We accept major credit cards through our secure payment processor
Payment Terms
- Payment is due immediately when billed
- If payment fails, you have 5 days to update your payment method
- After 5 days of non-payment, your service will be suspended
- After 30 days of non-payment, your account will be cancelled
Refunds
- 30-day money-back guarantee for new customers
- No refunds for partial months of service
- Refunds processed within 5-7 business days
5. Acceptable Use
Appropriate Use
CouchAlert is designed for legitimate business emergency calls. Appropriate use includes:
- Routing genuine emergency service calls
- Training your team on proper emergency response
- Managing after-hours customer emergencies
Prohibited Activities
You may not use CouchAlert for:
- Illegal activities or fraudulent purposes
- Harassing, threatening, or abusing others
- Spamming or unsolicited marketing calls
- Interfering with our service or other customers
- Attempting to access other customers' data
- Using the service for personal, non-business calls
6. Service Availability and Reliability
Uptime Commitment
We strive for 99.9% uptime and have multiple redundancies in place. However:
- No service is 100% reliable
- We're not liable for brief service interruptions
- We'll notify you of planned maintenance when possible
- Emergency calls will forward to your backup number if our system fails
Force Majeure
We're not responsible for service interruptions caused by events beyond our control, including natural disasters, internet outages, or telecommunications failures.
7. Cancellation and Termination
Your Right to Cancel
- You can cancel anytime with 24 hours notice
- No cancellation fees or penalties
- Service continues until the end of your billing period
- We'll export your call logs before account closure
Our Right to Terminate
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Fail to pay for more than 30 days
- Use the service for illegal activities
- Abuse our support team or other customers
8. Limitation of Liability

Please read this section carefully as it limits our liability to you.
Service Limitations
CouchAlert is a communication tool, not an emergency service. We are not responsible for:
- The quality of service your team provides to customers
- Decisions made by your employees during emergency calls
- Damages caused by delayed or missed emergency responses
- Loss of business due to service interruptions
- Third-party telecommunications failures
Maximum Liability
Our total liability to you is limited to the amount you paid for CouchAlert in the 12 months before the incident, up to a maximum of $1,000.
Emergency Services Disclaimer
CouchAlert is not a replacement for 911 or other emergency services. For life-threatening emergencies, always call 911 first.
9. Privacy and Data Protection
Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key Privacy Points
- We collect only the data needed to route your calls
- We never sell your data to third parties
- Call recordings are automatically deleted after 90 days
- You can export or delete your data anytime
10. Intellectual Property
Our Rights
CouchAlert, our logo, and our technology are our intellectual property. You may not:
- Copy or reverse engineer our software
- Use our trademarks without permission
- Resell our service to other businesses
Your Rights
You own your customer data and call logs. We won't use your business information for our own marketing without permission.
11. Changes to These Terms
We may update these Terms occasionally. When we do:
- We'll email you at least 30 days before changes take effect
- We'll post the new Terms on our website
- Continued use of CouchAlert means you accept the new Terms
- If you don't agree, you can cancel before the changes take effect
